The short version: these are the rules for using our website and buying Mossi. Nothing here takes away your rights under Australian consumer law.

About these terms

This website is operated by Mossi (“Mossi”, “we”, “us” or “our”). By using our website or placing an order, you agree to these terms, together with our Privacy Policy, Refunds & Returns Policy, Shipping & Delivery Policy and Subscription Terms.

Your consumer rights

Our products come with guarantees that can’t be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those rights.

Who can order

You must be 18 or over, or have a parent or guardian’s permission, to place an order. We currently deliver within Australia only.

Accounts

If you create an account, please keep your login details secure and let us know straight away if you think someone else has accessed it. You’re responsible for orders placed through your account.

Suspending accounts

We may suspend or close an account that’s used to misuse our website or breach these terms.

Our products

We do our best to describe and show our products accurately, but colours and appearance can vary slightly from what you see on screen. The label on your jar is the primary source of product information, including ingredients, allergens, storage directions and best-before date. Please read it before consuming.

Health and safety

Mossi is a food, not a medicine. It isn’t intended to diagnose, treat, cure or prevent any disease.

If you’re pregnant or breastfeeding, have a medical condition, or take any medication, check with your healthcare professional before consuming Mossi. Always check the label for allergen information.

Prices and payment

All prices are in Australian dollars and include GST. Shipping costs are shown at checkout before you pay.

We accept the payment methods shown at checkout. If you pay using a provider such as Afterpay or PayPal, their terms also apply to that payment.

Price changes

We may change our prices at any time. Changes won’t affect orders we’ve already confirmed.

Orders

When you place an order, we’ll send you an order confirmation email. At that point, a contract is formed between you and us.

We may cancel an order and give you a full refund if:

• there’s an obvious error in the price or product description;

• we’re unable to supply the product; or

• we reasonably suspect the order is fraudulent or breaches these terms.

If you’d like to cancel an order before it’s dispatched, contact us at info@mossi.au as soon as possible. We’ll consider requests at our discretion, but we can’t cancel an order once it has been dispatched.

Personal use only

Our online store is for personal use only. Products bought through our website must not be resold. We may limit quantities, or cancel and refund orders we reasonably believe are for resale.

Discount codes

Unless stated otherwise:

• only one discount code can be used per order;

• discount codes can’t be combined with other offers;

• discount codes have no cash value and can’t be exchanged for cash; and

• we may change or end a discount code at any time. This won’t affect orders already placed.

Delivery, refunds and subscriptions

Delivery is covered by our Shipping & Delivery Policy. Refunds and faulty products are covered by our Refunds & Returns Policy. Subscriptions are covered by our Subscription Terms.

Events outside our control

We’re not responsible for delays or failures caused by events outside our reasonable control, such as severe weather, natural disasters, carrier or supply disruptions, or outages of third-party services. If this affects your order, we’ll let you know and, if we can’t fulfil it, refund you.

Reviews and content you submit

When you submit a review, rating, photo or other content to our website, you:

• confirm it’s your own honest experience and your own content;

• give us a non-exclusive, royalty-free, worldwide licence to use, reproduce and share it on our website, social media and marketing, and to credit you by the name you provided; and

• agree it doesn’t contain anything unlawful, offensive or misleading, or anyone else’s personal information.

We may remove content that’s offensive, unlawful, spam, off-topic, false or misleading (for example, fake reviews or reviews of a different product), that makes health or medical claims we’re not permitted to publish, or that contains personal information.

Using our website

Please use our website lawfully. Don’t attempt to interfere with its operation, access it through automated means such as scraping, or misuse it in any way. We may suspend access for anyone who does.

Our intellectual property

Everything on our website, including the Mossi name and logo, our label designs, illustrations, photos, videos and written content, is owned by or licensed to Mossi and protected by Australian intellectual property law.

You must not copy, reproduce, modify, distribute or otherwise use any of it without our prior written permission, except as permitted by law. This includes using our name or logo in a way that suggests you’re connected with or endorsed by us.

If you use our intellectual property without permission, we may take legal action, including seeking damages, an account of profits, and orders to stop the use.

Our liability

Nothing in these terms limits our obligations under the Australian Consumer Law.

Apart from those obligations, we’re not responsible for:

• loss that isn’t reasonably foreseeable;

• loss caused by not following the label directions; or

• our website being temporarily unavailable or containing minor errors.

Changes to these terms

We may update these terms from time to time. The version in place when you place an order applies to that order.

If something goes wrong

If you have a problem with an order or these terms, please contact us at info@mossi.au first so we can try to fix it. This doesn’t affect your rights under the Australian Consumer Law.

If part of these terms doesn’t apply

If any part of these terms is found to be invalid or unenforceable, the rest of these terms will still apply.

Governing law

These terms are governed by the laws of Queensland, Australia. The courts of Queensland have non-exclusive jurisdiction.
